Throwing the Party: How the Supreme Court Puts Political Party Organizations Ahead of Voters/ Dr. Wayne Batchis

Political parties are, like voluntary clubs, associations of individuals that are represented by a singular organization. However, political parties also are the voters who choose and support their candidates; the elected officials who govern their localities, states and nation; the activists and volunteers who contribute their time and energy; and the donors who open their wallets. Unfortunately, the Supreme Court's framework for understanding America's two-party system has largely ignored this broader conception of political parties. Instead, it has treated parties the same way it treats other associations, granting First Amendment rights to political parties the same way it has to corporations and organizations. This discussion will examine how the Court's approach has distorted American politics and encouraged judicial intervention into a sphere the Framers of the Constitution explicitly delegated to state and federal legislators.​
